Terms of Service

These Terms govern your use of the Filmly mobile app, the Filmly web app at filmly.us, and the Filmly App Clip (together, “Filmly” or the “Service”). The Service is operated by Cheng ([email protected]). By using the Service you agree to these Terms.

1. Account & eligibility

You must be at least 13 years old to use Filmly (16 in some jurisdictions). Hosts who want to publish a shareable event must sign in with a verifiable email address. You are responsible for keeping access to that email secure.

2. What Filmly provides

Filmly provides hosted event-photo sharing: hosts create an event with a short code, guests join the event by scanning a QR code, the Service captures and stores those photos and reveals them according to the host’s configuration, optionally generates a short Reel movie, and lets the host moderate the album.

3. Your content

You retain all ownership and copyright in the photos and videos you capture (“Content”). You grant Filmly a non-exclusive, worldwide, royalty-free license to host, transmit, compress, transcode, and display your Content solely for the purpose of operating the Service (delivering it to participants of your event, generating the Reel, etc). This license terminates when you delete the Content or your account.

You promise that you have the right to capture and share the Content, including any necessary consents from people pictured. You will not upload Content that is illegal, infringing, hateful, harassing, sexually explicit, or otherwise prohibited by the App Store / Play Store policies.

5. Purchases

Filmly sells one-time per-event tiers (Mini, Standard, Premium, Unlimited). Purchases are processed by Apple App Store or Google Play and are subject to their respective billing terms. Each purchase credits a single event of the corresponding size; tokens are consumed when you create an event of that size.

Refunds are handled by Apple or Google per their store policies. Filmly cannot directly refund a store purchase but will honor any refund those stores issue.

Filmly is provided on an “as is” and “as available” basis. We will make commercially reasonable efforts to keep the Service running but make no uptime guarantees. The Service depends on third-party providers (Supabase, Cloudflare, Apple / Google push services, Fly.io) whose outages will affect Filmly.

8. Termination

You can stop using the Service at any time. Hosts can delete their account from Settings → Delete account, which deletes the account and cascades to all hosted events. We may suspend or terminate accounts that violate these Terms.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Filmly’s aggregate liability for any claim arising out of or in connection with the Service shall not exceed the amount you paid to Filmly in the twelve months preceding the event giving rise to the claim, or USD 50, whichever is greater. In no event will Filmly be liable for indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold Filmly harmless from claims arising out of your Content or your breach of these Terms.

We may update these Terms. Material changes will be posted here with an updated effective date. Continued use after the change constitutes acceptance.

13. Governing law & disputes

These Terms are governed by the laws of your country of residence to the extent required, and otherwise by the laws of the People’s Republic of China. Disputes will first be attempted to be resolved in good faith via email to [email protected].
